Nikki Floris and Bradley Benavides now face potential prison sentences after the Justice Department filed perjury charges against them. Both men were released by a federal magistrate judge on Friday morning following a brief court appearance. The indictment alleges they intentionally lied to the House Judiciary Committee in 2023 regarding the FBI's handling of investigations into Hunter Biden.

Floris served as the lead analyst for the intelligence division in the FBI's Washington field office. Benavides held the title of deputy assistant director for counterintelligence. Prosecutors claim both men withheld key details about their involvement in the bureau's probes. A maximum sentence of five years in prison awaits either defendant if convicted.

US Attorney Jeanine Pirro stated that the pair undermined the institutions they swore to uphold. She argued that senior agents lying to Congress strikes at the heart of the democratic system. Pirro said it was time to bring the hammer of justice down on them, noting they acted as if they were above the law.

An FBI affidavit details specific discrepancies in their testimony. Floris denied any involvement in the Hunter Biden cases during her 2023 deposition. The document states she was in frequent communication with the case team for over a year. It also claims she coordinated the bureau's response to news stories about the laptop in real time, despite testifying she knew nothing about it.

Benavides testified a few months after Floris. He told the committee he had learned about the laptop from a Wikipedia entry while preparing for his appearance. The affidavit contradicts this by stating he was in constant communication about the device over several days. A committee member said these answers thwarted follow-up interviews and subpoenas.

Defense lawyers rejected the allegations immediately. They said the government accused Floris falsely on the say-so of politicians rather than the facts. They described her as a patriot who served for nearly 20 years. Their attorneys argued the timing was no coincidence, noting the charges were filed on the eve of an election. Ron Safer, Benavides' attorney, urged the court to hold a hearing on whether prosecutors had enough evidence against two lifetime public servants.

US Magistrate Judge Zia M. Faruqui raised concerns about the timing of the case. He noted the charges came more than three years after the original testimony. Faruqui granted the defense request for a hearing to weigh the government's evidence, setting it for Tuesday. He called the timeline rare, adding that the matter would follow the defendants for the rest of their lives.

The laptop at the center of the dispute was handed to the FBI in 2019. A computer shop owner told authorities that Hunter Biden had dropped it off and never returned to collect it. The owner stated he turned it over after viewing some of its contents. The case unfolds as many FBI agents accused of working against President Donald Trump have been pushed out of the bureau since his second term began.
